What is a party wall agreement? +
A party wall agreement, or party wall award, is a document that sets out how work affecting a shared wall or boundary will be carried out. It protects both you and your neighbour, and is required under the Party Wall etc. Act 1996 for many extension and loft projects in London.
When do I need a party wall notice? +
You need to serve a party wall notice if your work involves building on or up to the boundary, cutting into a shared wall, or excavating within three to six metres of a neighbouring building. This covers most rear extensions, loft conversions and basement works.
How long does the party wall process take? +
Once a notice is served, your neighbour has 14 days to respond. If they consent, the process is complete. If they dissent or do not reply, a surveyor prepares a party wall award, which usually takes a few weeks. It is worth starting early, before building work begins.
Who pays for the party wall surveyor? +
As the person carrying out the work, you normally pay the reasonable surveyor fees, including your neighbour's surveyor if one is appointed. Our fixed-fee service tells you the cost up front, so there are no surprises.
What happens if my neighbour dissents? +
If your neighbour dissents, a party wall surveyor is appointed to prepare a party wall award that sets out how and when the work proceeds. Dissent does not stop your project; it simply means the terms are agreed formally through the surveyor.
