BUILD TEAM HOLBORN LIMITED - TERMS AND CONDITIONS
- Prices are subject to the addition of VAT at the prevailing rate.
- The estimate is based on the drawings and detail therein, as provided by the client and Build Team Holborn Limited cannot accept any responsibility for errors contained in these.
- The price estimated is valid for 30 days from the date of the estimate. Thereafter Build Team Holborn Limited may at its discretion change the price.
- The client has confirmed (having taken appropriate advice from a surveyor or structural engineer as may be appropriate) that they are responsible for ensuring that all walls to be moved or all walls through which new doorways are to be made, are non load bearing, and are responsible for obtaining the appropriate planning permission, listed building consent, building control approval and party wall approvals, and Build Team Holborn Limited does not accept responsibility for costs or delays directly or indirectly caused by the failure of the client or their professional advisers to obtain the same.
- All new fixtures and fittings, unless otherwise stated in the estimate, shall be provided by the client.
- The estimate is subject to a site visit and Build Team Holborn Limited’s structural engineer’s assessment and calculations (where necessary) and may be amended in writing in the light of those.
- Timescales are estimated and dependent on material and labour availability. Time is not of the essence. Timescales are estimated in working days rather than calendar days, and assume that weekends and public holidays will not be worked and that unimpeded access is provided by the client.
- The copyright of all of Build Team Holborn Limited’s designs, drawings, specifications etc, shall at all times belong to them.
- If the client delays the agreed start date or the works once in progress for any reason, a suspended works charge being a genuine pre-estimate of the loss is payable, pro-rata for the man days making up the delay, as well as any associated material, labour and overhead costs.
- Materials, suites and appliances which have been selected by the Client cannot be changed after being purchased by Build Team Limited. If requested by the Client, Build Team Limited can purchase specific materials selected by the Client but in that event there is 20% administration and handling fee payable by the client in respect of items purchased in this way, over and above their retail price.
- The Client is not permitted to commission the whole or any part of works referred to in the estimate, once accepted from any other Contractor (whether or not they are a Build Team Holborn Limited Employee). Nor during the currency of the works may the client approach any employee of Build Team Holborn Limited to undertake other works on their behalf for a period of 12 months after completion of the contract works. In the event of any breach of this provision Build Team Holborn Limited is entitled to payment equivalent to 120% of the full contract sum of any such works commissioned, as a genuine pre-estimate of its loss. Such sum shall be payable forthwith irrespective of whether the Employee or Contractor has been paid, or whether those works have actually been commenced.
- The Client is not permitted to discuss pricing issues with the team engaged by it on site, unless prior written authorisation has been given by Build Team Holborn Limited.
- The price estimated by Build Team Holborn Limited is based on the assumption that any client supplied items are designed for standard UK plumbing and electrical fitting, sizes and ratings. If they do not meet these standards Build Team Holborn Limited may increase the estimate price to cover the cost of any extra labour and materials used to adapt or change the client supplied items in order to complete the works so far as is reasonably practicable.
- Unless otherwise stated all tiling is assumed to be ceramic, non mosaic and no smaller than 20cm square, and of a uniform width and thickness.
- Any spot lights supplied by Build Team Holborn Limited will be standard 50w with white surround, unless otherwise specified.
- We recommend that all furniture, picture and delicate items are removed from the works area, including access areas, during the works, and those remaining are adequately protected by dust sheets or as may be appropriate and Build Team Holborn Limited cannot accept responsibility for damage to items not adequately protected by the client. Build Team Holborn Limited also advises that all valuables are removed from site, because building sites can be prime targets for theft.
- Build Team Holborn Limited will always endeavour to maintain security and avoid damage to the client’s property. However, accidental damage while carrying out building works can sometimes occur.
- The client shall provide adequate power and water supplies from the appropriate utilities on site to enable the contractor to work and shall be responsible for meeting the cost of the same.
- For pricing purposes it is assumed that there is no asbestos or other hazardous material in or at the property. It is the client’s responsibility to ensure its safe removal from the property.
- Items not specifically mentioned in this estimate are excluded from the works and pricing. Build Team Holborn Limited shall be under no obligation to carry out extra works. Works additional to the original contract or specification will be treated as additional works and will be charged as such. Additional items are due for payment on their completion and without retention.
- The materials and labour supplied by Build Team Holborn Limited are guaranteed for twelve months from the date of practical completion of the works.
- This guarantee is voided if others have worked on Build Team Holborn Limited’s works during the guarantee period without Build Team Holborn Limited’s express prior written authorisation, which Build Team Holborn Limited may refuse if they (or their authorized agent) have not been first granted access in order to inspect any potential guarantee issues or other alleged defects or damage.
- All payments are to be made by electronic CHAPS or BACS transfer to Build Team Holborn Limited.
- A non-refundable deposit of 50% of the estimate price is required to be paid in advance before the works can commence or as stated in the payment terms of the contract.
- If the customer causes delays to the works (either before or during the performance of the works) or cancels all or part of the works, Build Team Holborn Limited has the right to the full, non-returnable deposit.
- Any payment that is countermanded or fails to be honoured will be subject to the application of an administration and interest charge of the greatest of 10% of the countermanded or dishonoured payment or £250.
- Payments subsequent to a countermanded or dishonoured cheque or other payment must be made by cash or banker’s draft. Works will be suspended until overdue payments are received and cleared. Late payments will be subject to an interest charge of 5% per calendar month above Barclays Bank’s base rate.
- Payment of the deposit signifies the client’s agreement to these Terms and Conditions.
- It is not the intention of the parties that any third party shall acquire any rights under this contract pursuant to the Contracts (Rights of Third Parties) Act 1999.
- This contract shall be subject to the laws of England and Wales and the Courts of England and Wales shall have exclusive jurisdiction to determine any dispute or difference between the parties touching, concerning or arising out of this contract or its alleged breach, but nothing in this provision shall prevent the parties from going (by consent) to mediation or engaging by consent in any similar process of alternative dispute resolution before or during the currency of any court proceedings.
